I object strenuously to the proposed new mis-gendering rule. You are forcing compelled speech, which flies in the face of our rights to free speech. If I see a man, no matter how he dresses or what he THINKS, I am capable of discerning his sex and calling it for what it is. This is some kind of Orwellian twisting of reality to force reasonable people to lie about reality.

Males can never become females. Gender Identity is a belief in one's mind, and what one thinks does not change the reality of one's sex. Sex is binary and immutable, and is determined at conception. Males have a Y chromosome with a functioning SRY gene (typically XY sex chromosomes), whose bodies are designed to produce small mobile gametes called sperm. Females typically have XX sex chromosomes, with bodies designed to produce large non-mobile gametes called eggs. Every human can be classified as male or female by the type of gamete their bodies produce or are designed to produce. That is a fact that cannot be changed by a thought in one's mind.

Allowing males to identify as females is contrary to reality, takes away the rights of female (and male) single sex areas including single sex sports, and is contrary to fairness and free speech to be able to speak the truth.

No one should be punished for speaking the truth, as that is a fundamental right. If a male wants to dress and act as a female that is his right, but he cannot compel me to believe in his lie.

If the Emperor has on no clothes, no one should be punished for calling out the truth of his nakedness! If I see a man, I can call him a man because that is the truth.

Banning the identification of a person's actual biological sex by labeling such identification as "hate speech" is a violation of a poster's right to free speech. It is not universally accepted that biological males or females can "transform" into a member of the opposite sex through any means, whether by plastic surgery and synthetic hormone treatments or through simply self-identification. The belief in the phenomenon of gender transformation is considered by many to be an ideology inconsistent with scientific fact and contrary to beliefs sincerely held by millions of people. Compelling commentors to conform to the premise of an ideology to which they do not subscribe is wrong.

Dear Meta Team,

I am writing to you from the perspective of someone who has detransitioned after having been deeply influenced by the information and narratives I encountered online, including on social media platforms like those operated by Meta. As someone who has experienced firsthand the impact of misinformation around gender identity, I feel it is crucial to share my story and urge you to allow space for a broader range of voices and opinions—voices that are not rooted in hate, but in the need for genuine, respectful debate on these issues.

When I was exploring my feelings about gender, I turned to social media for answers. Unfortunately, what I found was a one-sided narrative that strongly promoted medical transition as the only valid solution for anyone questioning their gender. There was little room for alternative viewpoints or discussions about the complexities of gender dysphoria, mental health, or the potential consequences of transitioning. Any content that expressed caution, or questioned whether transition was the right path for everyone, was often censored or labeled as "hate speech" or "transphobia." As a result, I made decisions based on incomplete information, which led to a path that ultimately wasn't right for me.

It was only after a long and painful process of self-reflection that I realized transition was not the answer to my struggles. I now know that gender dysphoria can have many underlying causes, including trauma and mental health issues, and that transitioning isn’t the right solution for everyone. For me, detransitioning has been an important part of reclaiming my life and identity. However, I am saddened that voices like mine are so often silenced or dismissed, making it difficult for others who may be in a similar position to find the support and resources they need to make informed decisions.

Meta’s current policies around Hate Speech and Bullying and Harassment, while well-intentioned, are inadvertently stifling important conversations about gender identity. Discussions that challenge the dominant narrative of immediate affirmation and medical transition are frequently suppressed, while voices like mine are often drowned out. There is a growing community of detransitioners and others who have concerns about how gender identity issues are handled, and we need to be heard—not silenced. This is not hate speech; it is a necessary part of understanding the full spectrum of experiences and ensuring that people have access to diverse perspectives before making life-altering decisions.

I also understand that there are technical challenges in enforcing policies at scale, and I recognize Meta’s desire to protect individuals from genuine harassment. However, labeling any dissenting opinion on gender identity as "hate speech" does not serve the goal of protecting people—it only limits the ability to engage in constructive dialogue. There is a difference between hate speech and legitimate critique, and I urge Meta to create clearer distinctions between the two. People like me who have lived through the consequences of misinformation need to be able to share our stories without being accused of bigotry.

In today’s sociopolitical climate, especially in the United States, the conversation around gender identity has become increasingly polarized. But it is precisely in this context that Meta has a responsibility to ensure that all voices are heard. People need the freedom to express caution, to explore alternative viewpoints, and to share their experiences—particularly when it comes to complex and deeply personal issues like gender transition. Ensuring that a diversity of opinions can coexist on your platforms will help create a more informed, balanced dialogue that benefits everyone, including transgender people.

In closing, I strongly urge Meta to reconsider how it applies its policies around gender identity discussions. Please allow space for a range of voices, including detransitioners, mental health professionals, and those who question whether medical transition is the right solution for everyone. Silencing these voices does not promote understanding—it only limits the resources available to those who need them most.

"Misgendering" as hate speech is forcing women to bend their knee to men who are biologically NOT women. The experience of growing up as a girl and going through female puberty are experiences unique to biological women. Those experiences have nothing to do with makeup, hair length, or clothing. Transgender "women" are reducing these experiences of biological women to only what is visible on the outside of a human being. Biological women are in danger of being erased by men who pose as women.

Correctly identifying someone’s sex is not “Hate Speech." Just because someone has an altered view of who they are, it does not require anyone to go along with that altered view. Pandering to the mentally ill will never improve their situation, only prolong the disease and make it worse. Reality is never something that should be punished. The voices of women's, LGB, and children's rights advocates must NOT be allowed to be silenced by the transgenderist political lobby.

The concept "gender identity" means pretending. I do not have a gender identity. I have a sex, which is female, and I am in a sex class, which is woman. (Other examples of sex classes that are female are hens and mares and lionesses.)

As a woman, I am of the oppressed sex (again: female) and the oppressed sex class (again: woman).

A man is in the sex class responsible for sex-based oppression of women. Any man claiming to have a "woman gender identity" is attempting to appropriate women's reality just as Rachel Dolezal appropriated the reality of black women.

Dolezal faced social ostracizing. You on the other hand wish to protect men's nonexistent right to continue pretending to be me. And you want to ban me for pointing that out.

I am real. I am not a man's fertile imagination. Demanding I pretend otherwise violates my human rights, and it doesn't even make life better for men pretending to be women. We all know what they are, even if women never say a word about it.

I am against the proposed policy to ban content deemed as "misgendering" or "hate speech".Here's why: What is called "misgendering" is actually just stating a person's gender based upon their sex that cannot be changed.A person has a right to self identify however he/she likes and the general public also has a right to either accept or deny one's self identification. That is free speech and is not hate.
The same applies to men invading women's spaces and sports:It is not hate,bullying nor harassment stating that women should have their own rights,spaces and sports and they do not feel safe nor comfortable having to share them with biological men.Segregating rights,spaces and sports was a won for women thanks to feminism and it should remain as such: Free from men whether they self identify as women or men.
Hate is when someone is using insults and is trying to instigate to physical or verbal harm against another. Stating that men are not women is not an insult.It is the reality.Stating that men cannot self identify as women in order to gain the rights of women is not instigation or attempt to physical or verbal harm.It is women trying to protect their rights,spaces and sports.

If you make a policy that states telling the truth is hate speech, then you create a farce.
People on the autistic spectrum cannot register telling lies, you would be discriminating against those people that cannot see one thing and say it is another.
No human can change sex.
Trans identified people are free to live their lives as they wish, and believe what they wish, but to enforce the speech of others, or insist that others believe their ideology, is not consistent with freedom of speech and belief.
I believe that trans identified people are trans identified people. They have not miraculously changed sex, as that is scientifically impossible.
If meta thinks that is hate speech then meta is insisting that people subscribe to an ideology that they do not believe in.
This is not hate speech, or opinion - this is factual, this is science, this is the world we live in.
I would not want to be rude to a trans person or go out of my way to upset them, but I cannot say I believe something that I do not. That woudl be disrespectful and discriminatory to me.

Regarding the inclusion of transgender people in single sex spaces, the data proves that this is dangerous for women and girls. Women and girls are vulnerable and some trans identified men are a danger to us. Women and girls need same sex (not gender) bathrooms, changing rooms, hospitals, mental health wards etc - anywhere that women and girls are vulnerable. Rapes and attacked have occured in all of these locations by trans identified men, the only way to stop that is to exclude all trans identified men. The same way we exclude all men from women's spaces, not because they are all predators, but because some of them are. This is all common sense, but is being pushed and pushed by extremists, who put male feelings ahead of female and child safety.

Regarding sports, again common sense (and all properly conducted studies) show that make bodies out perform female bodies. If male bodies are allowed to compete in female sports, then there is no fair, safe female sport. Women and girls are already being injured by males who identify as women, its only a matter of time before a women or girl loses their life.

It would be great if males in female sport could be banned before that happens. Again, male feelings prioritised over female safety.

The right to properly identify the sex of an individual or groups of individuals
The right to advocate for women’s single-sex spaces (including in sports) for the purpose of protecting women’s safety, dignity, and societal advancement
The right to advocate for women’s rights, with recognition that there is a known conflict between laws and policies promoting "gender identity" and women’s rights.
The right to advocate for LGB rights, especially the protection of lesbians, including protection from heterosexual biological males who call themselves lesbians.

I am a woman, and a feminist. Free speech is a human right. We are free to to be wrong.

There are laws to protect us from those who would incite violence with their words. These laws are just and justified.

I am a gay man, an atheist, centrist Democrat and a sex realist. I believe that there are two sexes, male and female. I do not believe in gender identity. I do not believe that males can become females or that females can become males. Gender identity ideology does not have a foundation in science but in philosophy. Gender identity ideology is not a fact, it is a belief very much like a religion.

I do not believe there are "trans kids." It has been shown that most children who are gender nonconforming (I was one) or who have gender dysphoria will desist during adolescence and discover they are gay or lesbian.

I believe that the current surge in people identifying as trans or nonbinary is not the result of trans people being more comfortable being who they are. Instead, the unprecedented surge in young people claiming trans identities results from indoctrination in schools and other institutions, peer influence/social contagion, and influencers on social media, among other factors. Today’s trans and gender identity movements did not emerge organically. Instead, they are the natural result of queer theory in academia. It has escaped the campuses and colonized society. I also believe that “trans” is a fad or a scene and that some of the people who claim to be trans are really trans-trenders instead.

Most teen girls and young women who claim to be trans are doing so as a response to mental health crises having to do with changes in their bodies at puberty and with the social transition from girl to woman. Autistic people are especially vulnerable to gender identity ideology because being trans gives them a sense of fitting in in a community and because of their black-and-white thinking makes the susceptible to believing that people can really change sex.

Men who claim to be women do not belong in women's-only spaces or in women's-only athletics. First, no man can be or become a woman. Secondly, they do not have lived experience as girls or women nor do they have lived experience in real women's bodies, It is not women's responsibility to provide these interlopers with a community. It is grossly unfair to real girls and women to allow males to compete against women because males have natural physiological advantages over females in sports that are greatly enhanced by the changes that come with puberty. It is tyrannical to compel real women to accept biological males in their midst. It is also a violation of freedom of association.

I do not believe anything I have stated this far is "hate speech." There are widely spread gender critical and sex realist beliefs on both sides of the political spectrum. It is anti-democratic to suppress dissent in social media or any media on a contested topic such as gender identity where opinions can and do differ. I should be able to say any of the things I expressed above without fear of being silenced or punished for violating community standards. Suppressing our speech on Facebook isn't going to make us go away. It will just make things that much harder for trans people and their allies when they venture beyond their intolerant protective bubble and into the real world.

I am writing as a deeply concerned bi-sexual and leftist feminist, passionate about social justice and the welfare of women. I appreciate the opportunity to provide feedback on Meta’s Hate Speech and Bullying and Harassment policies, especially as they relate to the contentious and often silenced discussion around gender identity, women’s rights, and freedom of expression.

As a radical feminist, I am committed to advancing the rights and dignity of all people, especially those most vulnerable to oppression. However, I am increasingly alarmed by the way discussions about sex and gender are being restricted under the guise of "hate speech" and "harassment"—particularly when it comes to addressing the reality of male violence against women. Meta’s policies, while aiming to protect, have unfortunately stifled meaningful discourse on these critical issues, particularly in relation to the growing presence of men who identify as women in women’s spaces.

From my perspective, as someone who has fought against male violence and discrimination my entire life, it is imperative that we are able to discuss openly the threat posed when men are allowed to self-identify into spaces specifically designated for women’s safety and privacy. Policies that prevent people from discussing sex-based differences and from using biologically accurate language in discussions about these issues ultimately silence women’s voices. It is not "bullying" or "harassment" to call a man a man—no matter how he identifies. We must be able to name male violence and male privilege for what it is if we are to protect women’s rights.

By suppressing critical discussions around these topics, Meta is inadvertently enabling a situation where women’s voices are censored, making it increasingly difficult to protect female-only spaces and preserve the hard-won rights of women. As a lesbian feminist, I am particularly aware of the impact this has on vulnerable women, including survivors of male violence who seek refuge in single-sex spaces and are now being forced to share those spaces with men who identify as women. These policies undermine the very idea of women’s spaces, and we should be able to talk about this without being accused of "hate speech."

Meta has also requested feedback on the technical challenges of enforcing bullying and harassment policies. I acknowledge that enforcing these policies at scale is a difficult task, but I believe this challenge cannot justify silencing women who express legitimate concerns about their safety and their right to maintain boundaries. Self-reporting mechanisms often favor the loudest voices, and in the case of gender identity issues, women who dissent are frequently labeled as "transphobic" and targeted for harassment themselves, simply for standing up for their own rights. This imbalance needs to be addressed.

In the United States today, the sociopolitical context around gender identity is highly polarized, and this is all the more reason to allow free and open debate. Shielding certain groups from any criticism—while ignoring the concerns of others—does a disservice to all. There needs to be space to discuss the material reality of sex, as distinct from gender identity, particularly when it comes to sensitive issues like access to single-sex spaces and participation in women’s sports. Women's safety and rights must not be compromised, and it is crucial that women are allowed to speak up without fear of censorship.

In conclusion, I urge Meta to reconsider the way its policies are being used to silence feminist voices and to recognize the legitimate concerns that women have about the erosion of our rights. It is not "hate speech" to discuss the reality of biological sex or to advocate for the protection of women’s spaces. Women must be allowed to call men what they are—men—when it is relevant to safeguarding our rights and safety. To restrict this is to endanger the very freedom of expression that Meta claims to uphold.

Thank you for considering my feedback. I hope you will take these concerns seriously and allow for a more open and honest dialogue on this critical issue.

First and foremost as a woman who also happens to run a women's adventure travel tour company, words matter. Sex-based protected spaces matter. WOMEN MATTER. What often gets overlooked in this hotly debated issue is WOMEN.

Everyone wants to accommodate Trans-women - with zero consideration of the woman experience. Take a look at Domestic Abuse statistics. Talk to any woman - she or a close friend/family member has been in a scary situation as woman. Ask if she often has her guard up when walking a street at night, confronting a stranger, getting through her day.

Women who have been in a traumatic situation with a male should not be forced to share spaces with biological male. It's extremely stressful and unfair.

Sex-based spaces also provide us safety - have you ever had to escape to a bathroom when a man gets agressive? I have.

Sports - oi. Don't get me started. Again, sports are more than just a competition. They provide community, personal development, leadership skills, teamwork skills, empowerment, confidence, friendship, and a safe space - whether with teammates or a coach.

We need our own spaces. And that's okay.

BUT we also need platforms to talk about it. Whether you like it or not, Facebook is a public platform where anyone can join for free. With an agressive algorithm that only shows certain material to users you are already narrowing the experience for users. And unfortunately the real world is no longer where people gain experience. It's thru social media.

“Misgendering” is not hate speech, it is an acknowledgment of reality.
People pretending to be the opposite sex are not subject to violence or discrimination at rates greater than other members of their sex. Although, trans identified men are several times more likely to be sexual predators than the general male population and prison statistics bear this out.
Preventing so-called misgendering prevents the accurate discussion of women’s issues, LGB issues, crime, safeguarding, and male pattern violence. This harms the pursuits of women’s rights, LGB rights, and protecting children and communities. Further, on the specific issue of sexual violence, forcing women to describe rapists as women is the height of cruelty.

Correctly stating biological facts is neither hate speech nor does it propose a threat to any human being alive.
Biological sex is an unarguable fact and human cannot change sex.

Pronouns are simple references to biological reality. They have no moral or psychological value; they are simple statements of fact. A person conceived by fertilization of an ovum with a Y chromosome is male; fertilization with an X produces a female. It is never "hate speech" to say this. There is no reasonable justification to prohibit the freedom of speech to refer to anyone by their actual sex. Even if you chillingly tey to punish free speech - ala "1984" dystopianism, virtually everyone believes that men are men (he/him/his) and women are women (she/her/hers). You will create a hostile communication environment by coercing people to lie about what we all know to be reality.

These two cases concern content decisions made by Meta, on Facebook and Instagram, which the Oversight Board intends to address together.

In the first case, a Facebook user in the United States posted a video of a woman confronting a transgender woman for using the women’s bathroom. The post refers to the person being confronted as a man and asks why it is permitted for them to use a women’s bathroom.

In the second case, an Instagram account posted a video of a transgender girl winning a female sports competition in the United States, with some spectators vocally disapproving of the result. The post refers to the athlete as a boy, questioning whether they are female.

Both posts were shared in 2024 and received thousands of views and reactions. They were reported for Hate Speech and Bullying and Harassment multiple times, but Meta left both posts up on Facebook and Instagram, respectively. After appealing to Meta against the company’s decisions, two of the users who reported the content then appealed to the Oversight Board.

Following the Board’s selection of these cases, Meta considered both posts under its Hate Speech and Bullying and Harassment policies and concluded that neither violated its Community Standards. Both posts remained up. Meta’s Hate Speech Community Standard prohibits direct attacks targeting a person or group of people on the basis of protected characteristics, including sex, gender identity and sexual orientation, with “exclusion or segregation in the form of calls for action, statements of intent, aspirational or conditional statements, or statements advocating or supporting [exclusion].” The Hate Speech policy does not include misgendering as a form of prohibited “attack.” Misgendering means referring to a person using a word, especially a pronoun or the way in which they are addressed, that does not reflect their gender identity. Meta informed the Board that neither post violated its Hate Speech policy, adding that even if the post in the first case could constitute a call for exclusion, it would still be kept up under the newsworthiness allowance, given “transgender people’s access to bathrooms that correspond to their gender identity is the subject of considerable political debate in the United States.”

Meta’s Bullying and Harassment Community Standard prohibits “cognizable attacks and calls for exclusion” targeted at a private minor, private adult (if reported by the targeted person) or an involuntary public figure who is a minor (including statements advocating or supporting exclusion of a person). The public-facing language of the Bullying and Harassment policy does not consider misgendering a person to be a cognizable attack or call for exclusion. Meta informed the Board that the content in the first case did not violate the Bullying and Harassment policy as there was “no explicit call for exclusion present in the post and because the post was not self-reported by the person depicted in the video.” The company stated that although the second post targeted a minor who Meta considers to be an involuntary public figure, it did not contain a “cognizable attack or call for exclusion” so did not violate this Community Standard. Meta explained that the company allows “more discussion and debate around public figures in part because – as here – these conversations are often part of social and political debates and the subject of news reporting.”

In their statement to the Board, the user who appealed the post in the first case explained that Meta allowed what in their view is a transphobic post to stay on its platform. The user who appealed the post in the second case said that the post attacks and harasses the athlete with language that in their view violates Meta’s Community Standards.

The Board selected these cases to assess whether Meta’s approach to moderating discussions around gender identity respects users’ freedom of expression and the rights of transgender and non-binary people. The cases fall within the Board’s Hate Speech Against Marginalized Groups and Gender strategic priorities.

The Board would appreciate public comments that address:

  • The impacts of Meta’s Hate Speech and Bullying and Harassment policies on freedom of expression around gender identity issues, and the rights of transgender people, including minors.
  • Technical challenges in enforcing bullying and harassment policies at scale, the effectiveness of self-reporting requirements and their impacts on people targeted by bullying or harassment, and comparisons to alternative enforcement approaches.
  • The sociopolitical context in the United States concerning freedom of expression and the rights of transgender people, especially for access to single-sex spaces and participation in sporting events.

As part of its decisions, the Board can issue policy recommendations to Meta. While recommendations are not binding, Meta must respond to them within 60 days. As such, the Board welcomes public comments proposing recommendations that are relevant to these cases.
