The Oversight Board is conducting new research to provide industry guidance on a holistic, human rights-based approach to the governance of AI chatbots for 13 to 17-year-olds. It is seeking stakeholder input to inform the resulting white paper. This year, the Board announced its intention to expand its work on industry-wide solutions for the most difficult challenges impacting users online, including young people. This project is part of the Board’s strategic priority on the rights and interests of young people.
AI chatbots (e.g., ChatGPT, Gemini, Claude) are increasingly a primary interface through which 13 to 17-year-olds access information, learn, form ideas, access entertainment and express their creativity. This has profound implications for a wide range of rights enshrined in the United Nations Convention of the Rights of the Child, including the rights to access to information, freedom of expression, privacy, health, education, play, participation in cultural life, and protection from violence and abuse. While these rights are interdependent and mutually reinforcing, they can also be in tension.
Since chatbots have become widely available, research into opportunities and potential harms from this technology is increasing. Measures taken by AI companies in response to emerging concerns are rapidly developing, but often without reference to the rights of young users. Some AI companies have responded by simply limiting access to adults rather than investing in product and policy changes focused on respect for the rights of younger users. How to properly respect the rights of children as their capacities evolve, what the role of parents and other caregivers should be, and how to consider the position of children globally are all issues that companies should be grappling with.
The Board brings its global experience in developing rights-based, scalable policies in the technology sector that navigate the tensions and synergies between freedom of expression and other human rights to this discussion. The resulting policy guidance for companies will help ensure respect for both the safety and information needs of young users.
The Board would appreciate public comments that address:
- How the risks and opportunities relating to AI chatbots impact the rights of 13 to 17-year-olds in different parts of the world.
- The impact and effectiveness of harm mitigation measures such as minimum age requirements, parental controls, age-based dialogue and prompt restrictions, and default account settings.
- Research regarding the performance of LLMs in low-resource languages, in particular in understanding high-risk interactions, addressing sensitive topics, and effectively deploying safeguards.
- Best practices and recommended approaches for the design and deployment of chatbots to address the risks associated with teen use.
